Refusals and FOI

Australian visa refused? Here is what actually works from India.

Start with your decision letter. Review rights and deadlines depend on the visa and decision. If reapplication is appropriate, understand the reasons and address the evidence that was missing.

1. Get the record

Request your file under the Freedom of Information Act 1982. Personal-information requests are free. The usual statutory period is 30 days, but extensions and delays can apply. Do not wait for FOI if a review deadline is approaching.

2. Decode the reasons

Match the letter to the criterion: Genuine Student, Genuine Visitor, financial capacity, relationship evidence or PIC 4020. Each has a specific fix.

3. Reapply differently

Fix the evidence gap and lodge a file the officer has not seen before. We check it against the previous reasons line by line.

The three refusal grounds Indians see most

  • Financial capacity (student visas). Since Evidence Level 3 began on 8 January 2026, officers verify statements with Indian banks. Unexplained deposits, borrowed balances and loan evidence may need further supporting documents.
  • Genuine Student or Genuine Visitor. The officer did not believe the story: a course that does not fit your background, weak ties to India, or a template statement.
  • Inconsistency and PIC 4020. Facts that differ between forms, or documents the department could not verify. PIC 4020 findings can carry exclusion periods, so never let an agent submit anything you cannot prove.

We cannot speak to the department on your behalf from India, and we do not need to: the FOI request and the new application are lodged in your name, with us preparing them with you.

Questions after a refusal

Can I appeal an Australian visa refused in India?+

Usually not. Student visas and tourist-stream visitor visas refused offshore have no merits-review right at the Administrative Review Tribunal. Sponsored family visitor visas and partner visas carry a review right exercised by the Australian sponsor.

How do I get my refusal file?+

Lodge a Freedom of Information request with the Department of Home Affairs for all documents about your application. Personal records are free, the standard decision period is 30 days, but lawful extensions and delays can apply, and the file shows the officer's notes and the evidence they weighed.

How soon can I reapply?+

Immediately, but reapplying with the same file produces the same result. Change the evidence that failed: traceable funds, a specific study plan, stronger ties, consistent documents. Use the refusal letter and the FOI file as your checklist.

Does a refusal affect future visas?+

You must declare it on future Australian applications and some other countries ask too. A refusal is not a ban unless the department found false documents under Public Interest Criterion 4020, which does carry an exclusion period.
